Terms of Use

medSOS · Version 1.0 · Effective 15 August 2026

medSOS is a free tool that helps you reach emergency services faster and carry your medical identity with you. It is not a medical device, not a medical service, and not a substitute for calling the emergency number in your country. Please read section 4 carefully — it is the one that matters most.

🔒Your medical data stays on YOUR device only

Never uploaded, sold, or shared. Permissions (location, contacts, notifications) are requested only when the feature that needs them is first used.

⚠️Important Disclaimer

This app may experience interruptions. www.medSOS.in shall not be liable for any claims or damages.

Always contact official emergency services (112, 911, 999) as the primary method. medSOS is supplementary only.

1 · Acceptance of these terms

By installing, opening or using medSOS — in a browser, as an installed PWA, or as a native application — you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the app.

If you are using medSOS on behalf of another person (a family member, a patient, a dependant), you confirm you are authorised to do so and you accept these terms on their behalf.

2 · What medSOS is

medSOS is a free consumer utility that provides:

It is provided free of charge, with no account, no subscription and no purchase.

3 · What medSOS is not

4 · Emergency use — read this

🚨In an emergency, dial your local emergency number directly

112 (India, EU and much of the world) · 911 (US, Canada) · 999 (UK) · or the number in force where you are.

Do not rely on medSOS, or on any app, as your primary means of summoning help. Phones fail, batteries die, apps crash, software updates break things, and networks drop. medSOS is a convenience layer over the phone functions you already have — nothing more.

📶"Works offline" does not mean "works without a SIM"

medSOS opens and functions with no internet connection. Your medical profile, emergency contacts, emergency-number directory and first-aid content are stored on the device and remain readable offline.

Placing a call is a separate thing entirely. Dialling an ambulance, the police, the fire service or one of your emergency contacts requires an active SIM card and mobile network coverage. medSOS hands the number to your phone's dialler; your phone and your mobile operator make the call. Without a SIM, without network coverage, or with a suspended or out-of-credit account, no call will connect — and that is outside our control.

Some devices and networks permit emergency calls without a SIM or while roaming; this varies by country, operator and handset, and we make no representation that it will work for you.

You accept that using medSOS in place of directly contacting emergency services is your own decision and at your own risk, and that any delay arising from doing so is not attributable to us.

5 · Your responsibilities

6 · Accuracy of emergency numbers and location

medSOS carries emergency numbers for 219 countries and territories, compiled from public sources. Numbers change, vary by region within a country, and are sometimes reachable only from certain networks. We make no warranty that any number is current, correct or reachable from your position.

Location accuracy depends entirely on your device and surroundings. GPS is unreliable indoors, underground, in dense urban areas and in poor weather. On desktop computers, position is estimated from network information and may be wrong by kilometres. Never assume the coordinates shown or shared are precise.

Connectivity

Offline capability applies to the app and its stored content only. Calling, sharing your location, finding nearby care and any map link all require connectivity — a mobile network for calls, and data or Wi-Fi for the rest.

7 · Availability and interruptions

medSOS is provided on an "as available" basis. It may be interrupted, suspended, degraded or discontinued at any time, with or without notice, for maintenance, technical failure, changes in browser or operating-system behaviour, or any other reason. We do not guarantee uptime and offer no service-level commitment. We may modify, restrict or withdraw any feature at any time.

8 · Third-party services

medSOS links out to third-party services including Google Maps, your dialler, messaging and email apps, and external health and emergency providers. We do not control these services, do not endorse them, and are not responsible for their content, availability, accuracy or practices. Your use of them is governed by their own terms.

9 · Intellectual property

medSOS, the medSOS name and logo, and all software, design, text and other content in the app are owned by us or our licensors and are protected by applicable intellectual-property law. You are granted a personal, revocable, non-exclusive, non-transferable licence to use the app for your own non-commercial purposes. You may not copy, modify, reverse-engineer, decompile, redistribute, resell or create derivative works from it, except where such restriction is prohibited by law.

10 · Acceptable use

You agree not to use medSOS to make hoax or malicious emergency calls; to harass, stalk or track any person without their consent; to interfere with emergency services; to circumvent security measures; or for any unlawful purpose. Misuse of emergency services is a criminal offence in most jurisdictions.

11 · Disclaimer of warranties

To the maximum extent permitted by law, medSOS is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including without limitation any implied warranty of merchantability, fitness for a particular purpose, accuracy, reliability, uninterrupted or error-free operation, or non-infringement.

We do not warrant that the app will meet your requirements, that defects will be corrected, that it will function during an emergency, or that any information within it is accurate, complete or current.

12 · Limitation of liability

To the maximum extent permitted by applicable law:

These limitations apply regardless of the legal theory on which a claim is based, and survive any termination of these terms.

13 · Indemnity

You agree to indemnify and hold harmless medSOS and TokenKart Health AI from any claim, demand, loss, liability or expense (including reasonable legal fees) arising from your misuse of the app, your breach of these terms, your violation of any law, or your infringement of any third party's rights.

14 · Consumer rights that cannot be excluded

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for death or personal injury caused by negligence, for fraud, or for other matters that cannot lawfully be limited. Nothing in these terms excludes or limits liability to the extent it may not lawfully be excluded or limited. In those jurisdictions our liability is limited to the minimum extent permitted by law, and you may have statutory rights in addition to those described here — including under the Consumer Protection Act 2019 (India), the Consumer Rights Act 2015 (UK), EU consumer law, and the Australian Consumer Law.

15 · Changes and termination

We may amend these terms at any time. The version number and effective date above will change, and material changes will be surfaced in the app. Continued use after a change constitutes acceptance. You may terminate at any time by uninstalling the app. We may suspend or terminate your access at any time, for any reason, without notice.

16 · Governing law and disputes

These terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts at Patna, Bihar, India shall have exclusive jurisdiction over any dispute — save that if you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings in your local courts, or to the benefit of mandatory provisions of your local law, those rights are unaffected.

Before commencing proceedings, we ask that you contact us so we can try to resolve the matter informally.

17 · General

If any provision of these terms is held unenforceable, the remainder continues in full force and the unenforceable provision is modified to the minimum extent necessary. Our failure to enforce any right is not a waiver of it. These terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding medSOS. You may not assign your rights under these terms; we may assign ours in connection with a merger, acquisition or sale of assets.
